Payment Methods

1. TERMS

The following expressions will have, for the purposes of these General Conditions, the meaning indicated:

NUDO: indicates Nudo S.r.l., with headquarters in Via Ugo Bartolomei 18, 00136 Rome, VAT number 16065981009 registered in the register of companies of Rome, n. REA RM - 1632562;

-Order Confirmation: means the communication sent to the Customer by Nudo, with which the latter confirms the successful purchase of the Products;

-Customer: indicates the natural person, who acts for purposes unrelated to his business and professional activity, who purchases the Products in accordance with these General Conditions;

-Consumer Code: means the Legislative Decree of 6 September 2005, n. 206;

-General Conditions: indicates these general conditions of sale of the Products;

-Contract: means the contractual relationship concluded between the Parties, for the purchase of the Products, consisting of these General Conditions and the Order, which is finalized following the Order Confirmation;

-Privacy Policy: means the information provided to the Customer for the use of personal data;

-Order: means the order that the Customer sends to Nudo for the purchase of the Products, in the manner set forth in art. 3;

-Parties: means, jointly, the Customer and Nudo;

-Products: means the coffee produced by Nudo and/or the other ancillary products sold on the Website;

-Receipt of the Order: means the communication sent to the Customer with which the same is informed that Nudo has received and taken charge of the Order;

-Website: means the website www.nudo-artisancoffee.com within which it is possible to purchase the Products.

2. SUBJECT

2.1 These General Conditions govern the purchase of Nudo branded Products made on the Website.

2.2 These General Conditions are those in force at the time an Order is placed.

2.3 Nudo reserves the right to modify these General Conditions at any time and to publicize them on the Website.

3. ORDERS - CONCLUSION OF THE CONTRACT
3.1 To purchase one or more Products, the Customer is required to complete the Order on the appropriate web page, indicating the name, surname, e-mail address, billing address and shipping.
3.2 Once the Order has been completed, the Customer must expressly accept these General Conditions and the Privacy Policy in the appropriate field indicated in order to proceed with the purchase of the Products. In the absence of acceptance of the aforem
entioned documents, the system will not allow you to proceed with the purchase.
3.3 Once the Order has been received, Nudo
will send the Customer, to the e-mail address indicated when completing the Order: (a) the Receipt of the Order; (b) the Order Confirmation, containing the Order number, the description, quantity and price of the Products and the delivery date.
3.4 Should problems arise in the Order process, Nudo will send the Customer an e-mail which will indicate the type of problem encountered and the methods for resolving it.
3.5 The Customer is free to place an Order for one or more Products, after registering on the Website or entering the data indicated in art. 3.1 every time you intend to make a purchase. 3.6 The Customer may modify the Order already sent within and no later than 8 hours from receipt of the Order Receipt e-mail, after which the same Order can no longer be modified, except in any case as provided by the art. 10 of these General Conditions.

4. PRODUCTS

Within the Website, the Customer will be able to verify the essential characteristics of the Products he intends to purchase. However, the images of the Products may not be perfectly representative of their characteristics and may differ in colour, size, products and accessories represented. All support information for placing the registered purchase order is intended as simple generic information material, not referable to the real characteristics of each individual Product.


5. PRICES

5.1 The prices of the Products are indicated on the Website and are inclusive of VAT.

5.2 Shipping costs will be charged to the Customer. For deliveries outside the EU, the obligation to pay the customs duties is the responsibility of the Customer.

5.3 Product prices may be subject to updates. In this regard, the Customer is invited to check the final sale price before submitting the relevant Order.

 

6. PAYMENT AND BILLING METHODS

6.1 Payment for the Products can be made by credit card or PayPal.

6.2 Against payment of the Products, Nudo will issue a regular invoice which will be sent to the Customer's email address provided when registering or purchasing the Product.

7. SHIPPING AND DELIVERY OF PRODUCTS

7.1 Shipments of the Products can be made both inside and outside the EU territory.

7.2 Nudo will ship the Products exclusively to the destination indicated in the Order.

7.3 Deliveries will take place within 5 working days from the Order Confirmation for shipments in the territory of the Italian Republic, San Marino and the Vatican City. Deliveries to countries inside and outside the EU will be carried out, from the Order Confirmation, within the times indicated at the time of placing the Order, not exceeding 7 working days.

 

8. PASSING OF THE RISK OF LOSS OR DAMAGED PRODUCTS

The risk of loss or damage to the Products, for reasons not attributable to Nudo, is transferred to the Customer only when the latter physically takes possession of the Products.

 

9. ACCEPTANCE OF PRODUCTS

9.1 The Products are understood to be accepted with the signature of the delivery document of the carrier appointed by Nudo.

9.2 In the event that the ordered Products have not been delivered intact or are of a lower quantity than that indicated in the Order, the Customer must notify Nudo within 5 working days of delivery, by registered letter with return receipt to the address Nudo SRL, via d'Ascanio 26/A 00186 Rome or by PEC to the address nudo@legalmail.it, with the specific description of the problem encountered
 

10. CUSTOMER'S RIGHT OF WITHDRAWAL - RETURN OF PRODUCTS

10.1 Pursuant to art. 52 of the Consumer Code, the Customer may exercise the right of withdrawal from the Contract within 14 (fourteen) days of receiving the Products.

10.2 The Customer will inform Nudo of the decision to exercise the right of withdrawal in the following ways:

(a) using the model withdrawal form referred to in Annex I, part B of the Consumer Code, or

(b) by submitting any explicit declaration of your decision to withdraw from the Contract, by sending a registered letter with return receipt to the address Nudo SRL, via D'Ascanio 26/A 00186 Rome or by PEC to the address nudo@legalmail.it.

10.3 Following the exercise of the right of withdrawal, Nudo will reimburse the Customer for all payments received from the latter, possibly including delivery costs, within 14 (fourteen) days from the day on which Nudo is informed of the decision of the Customer to withdraw from the Contract.

10.4 Nudo will make the refund referred to in the previous art. 10.3 using the same payment method used by the Customer for the transaction relating to the purchase of the Products, unless the Customer has expressly agreed otherwise.

10.5 The costs of returning the Products to Nudo shall be borne by the Customer, pursuant to and for the purposes of art. 57 of the Consumer Code.

10.6 Returned Products that have suffered a decrease due to improper use by the Customer will not be refunded or will be partially refunded.
 

11. LEGAL GUARANTEE OF CONFORMITY IN FAVOR OF THE CUSTOMER

11.1 Nudo is liable to the Customer for any lack of conformity existing at the time of delivery of the Products, pursuant to articles 128-135 of the Consumer Code.

11.2 The lack of conformity must be reported by the Customer within two months from the date of discovery of the defect and no later than 24 (twenty-four) months from the date of purchase of the Products.

11.3 If the Products present defects of conformity which limit or significantly reduce the suitability for use of the Products, the Customer has the right, without charge, to the replacement of the Products or to an adequate reduction in the price or to the termination of the Contract.

11.4 The Customer may request, at his choice, the replacement of the Products, free of charge in both cases, unless the remedy requested is objectively impossible or excessively onerous compared to the other.

11.5 In the event of replacement of the Products, the return shipping costs will be borne by Nudo and will therefore be reimbursed to the Customer.

11.6 All defects resulting from negligent or improper use of the Product are not covered by this guarantee.

 

12. PRIVACY

For all information on the methods in which personal data is processed, please consult the information on the processing of personal data (Privacy Policy).
 

13. ACCIDENTAL CASES AND FORCE MAJEURE

13.1 The expression "unforeseeable circumstances" or "force majeure" means any event, also involving third parties and/or public authorities, which is unforeseeable or inevitable and in any case beyond the control of Nudo, the occurrence of which is not due to or omissions attributable to the same, by nature and entity, which is in itself such as to prevent the fulfillment of the contractual obligations.

13.2 Nudo cannot be held responsible in any way in the event that it fails to fulfill the obligations deriving from these General Conditions, if the failure depends on a cause not attributable to it (fortuitous event and/or force majeure) and provided that did not in any way contribute to determining them.

 

14. APPLICABLE LAW AND JURISDICTION

14.1 The Contract is governed by the legislation in force in the Italian Republic. In particular, the provisions of the Civil Code and the discipline dictated on consumer rights pursuant to the Consumer Code will apply.

14.2 Pursuant to art. 66-bis of the Consumer Code, for any dispute that may arise between the Customer and Nudo regarding the execution and/or validity and/or termination and/or interpretation of the Contract, the local judge will be competent of residence or domicile of the Customer, if located in the territory of the Italian State. Otherwise, the competent Court will be that of Rome.
 

15. ALTERNATIVE RESOLUTION OF OUT OF COURT DISPUTES WITH CUSTOMERS

15.1 For the out-of-court settlement of disputes deriving from the purchase of the Products, the Customer can use the online platform made available by the European Commission at the following address: http://ec.europa.eu/consumers/odr/.

15.2 For the out-of-court settlement of disputes, please refer, in any case, to the provisions of articles 141-141-decies of the Consumer Code.

 

16. CUSTOMER SERVICE

In the event that an inconvenience should occur in the Order fulfillment procedure, the Customer may contact Nudo at the e-mail address ciao@nudokopiroasters.com, in order to find the most suitable solution for the definition of the problem encountered.
